1. Who these terms are between

These terms govern the arrangement of road freight transport by Ganpati Trailer Service (Ganpati Trailer Service) for a business customer. By asking us to arrange a consignment, you accept them.

2. What we do

We are a freight broker. We contract with you to move a consignment, and we separately engage a truck owner to carry it. We are not a common carrier and we do not own the vehicles. Our obligation is to arrange competent, lawfully documented carriage and to manage the consignment through to delivery.

3. Booking and pricing

  • A quotation is given for a stated route, weight, vehicle type and date. It is valid for the period stated when quoted.
  • A booking is confirmed when we tell you a vehicle has been assigned. Until then no vehicle is reserved.
  • The agreed price is fixed for the consignment as described. If the actual weight, dimensions, route or waiting time differ materially from what was described, the price may be revised and we will tell you before proceeding.
  • Detention, loading and unloading charges, tolls, permits and state entry fees are payable as quoted or at actuals where stated.

4. Your responsibilities

  • Describe the goods accurately, including weight, nature and any special handling requirement.
  • Ensure the goods are packed adequately for road transport, and loaded and unloaded within the agreed free time.
  • Provide all documents the law requires for movement, including the e-way bill and invoice, before the vehicle departs.
  • Do not tender prohibited, hazardous, illegal or undeclared high-value goods without our prior written agreement.

5. Delivery times

Transit times are estimates given in good faith. Road transport in India is affected by traffic, weather, strikes, checkpoints and regulatory action. We do not guarantee a delivery time unless we have agreed one in writing for a specific consignment.

6. Loss and damage

  • Claims must be reported to us within seven days of delivery or expected delivery.
  • Liability for loss or damage is limited to the amount recoverable from the carrier or under the applicable goods-in-transit insurance, and in any case does not exceed the freight charge for the consignment, unless a higher value was declared and separately insured before dispatch.
  • We are not liable for indirect or consequential loss, including loss of profit, loss of contract or production downtime.

7. Payment

Invoices are raised on the terms agreed at booking and are payable by bank transfer. GST is charged as applicable. Overdue amounts may attract interest at the rate stated on the invoice, and we may decline further bookings while an account is overdue.

8. Cancellation

Cancellation is covered by our refund and cancellation policy, which forms part of these terms.

9. Truck owners

A truck owner engaged by us must hold a valid driving licence, vehicle registration certificate and insurance, and must keep them current. We verify these before assigning a load and may withdraw work where they lapse. A truck owner is an independent contractor and not our employee.

10. Suspension

We may suspend or decline service where these terms are breached, where documents are invalid or expired, or where we reasonably believe the goods or the movement would be unlawful.

11. Governing law

These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts at [city], India.
